Course content

- Partim “General criminal law” The first part of the course is devoted to general criminal law. It consists in the study of criminal law (its general features, its autonomy, interpretation rules, implementation in time and space, personal scope, evidence), of the offence (categories, substantive element or criminal intent etc.), of the offender (subjects of penal law, offences imputation or attribution, justification causes, etc) and of the penalty (purposes and functions, categories, civil consequences, suspension, reprieve, probation, deprivation of liberty, alternative sanctions, measures of social defense, causes of extinction of public action and of punishment). The course is exemplified through case-law. - Partim “Specific penal law” The second part of the course is devoted to the study of specific criminal law aims in particular at illustrating the first part of the course, namely the part devoted to general penal law. Such study begins with a general introduction which is then followed by an analysis of the Book II of the Belgian penal Code, which is related to specific offences and their punishment. The following offences are especially studied: offences against persons, against properties, against families and public morals, against public security and terrorist offences. Some specific laws which are not part of the penal code are studied as well, such as the law related to drugs.

The lectures aim - at understanding the general principles underlying and governing criminal law - at showing the importance of criminal law among the other legal fields and other disciplines (morals, criminal phenomena, criminology, etc…) - at presenting the main mechanisms of criminal law as well as its objectives.
